Terms of Service

Listing Liyo is an independent third-party application. We are not affiliated with, sponsored by, or endorsed by Etsy, Inc. in any way. All references to Etsy are for descriptive purposes only.

Listing Liyo is a listing management tool designed for Etsy sellers. The Service allows users to connect their Etsy shops via OAuth 2.0 and manage their product listings through our platform. The Service accesses only the following Etsy API permission scopes: listings_r, listings_w, shops_r, and shops_w. The Service does not access buyer data, order data, or financial information.

You must be at least 18 years of age and have a valid Etsy seller account to use the Service. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By using the Service, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms;
• Comply with Etsy's Terms of Use and API Terms of Use;
• Not attempt to gain unauthorized access to any part of the Service or its related systems;
• Not use the Service to transmit any harmful, offensive, or unlawful content;
• Not reverse-engineer, decompile, or disassemble any part of the Service.

The Service and its original content, features, and functionality are and will remain the exclusive property of Seven8Six Labs LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service.

The Service integrates with Etsy's API. Your use of Etsy's platform is governed by Etsy's own Terms of Use and Privacy Policy, which are independent of these Terms. We are not responsible for the availability, accuracy, or content of Etsy's services.

All payments are processed securely by Stripe, Inc. Listing Liyo does not store your credit card number, CVV, or full payment details. By providing payment information, you also agree to Stripe's Terms of Service.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SEVEN8SIX LABS LLC, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SEVEN8SIX LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF SEVEN8SIX LABS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless Seven8Six Labs LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at support@listingliyo.com.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Williamson County, Texas, for the resolution of any disputes not subject to arbitration.

Informal Resolution. Before initiating any formal dispute process, you agree to first contact us at support@listingliyo.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Binding Arbitration. If the dispute cannot be resolved informally, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Leander, Texas, or via remote hearing. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated on a class-action basis.

Exceptions. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to intellectual property rights or unauthorized access to the Service.

Free Plan: Free to use, no credit card required. Includes 1 connected shop with basic editing and monthly usage limits. May be discontinued with 30 days' prior notice.

Starter ($9.99/mo), Growth ($24.99/mo), and Scale ($34.99/mo) Plans: Subscriptions are billed monthly in advance via Stripe. Subscriptions automatically renew unless cancelled beforehand. Annual payment option available at a discounted rate. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods or unused time. Price changes will be communicated at least 30 days in advance.

Trials and Promotions: We may offer limited-time trials or promotions at our discretion. If a trial or promotion applies, the details and renewal terms will be shown clearly at checkout.

For billing disputes, contact us within 30 days at support@listingliyo.com.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on the Service or sending an email to the address associated with your account. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Seven8Six Labs LLC regarding the Service and supersede all prior agreements and understandings.
